New Bankruptcy Law – Five Essential Things to Know

Last April, Congress passed the Bankruptcy Abuse and Consumer Protection Act, the most sweeping reform of our nation’s bankruptcy laws in more than twenty-five years. Proponents of the bill argue that most consumers who file for bankruptcy do so simply because they do not wish to pay their bills. That is an arguable point, as studies show that most bankruptcy filers have suffered illness, injury or job loss. Regardless of the reasons, Congress has made the changes, and millions of Americans will be affected when the new law takes effect on October 15.

Here is a short list of the changes and how consumers will be affected.

  • Goodbye, Chapter 7 – Until now, most consumers have been permitted to file under Chapter 7 of the Federal bankruptcy code. Chapter 7 permits the court to wipe away most consumer debt, allowing the debtor to make a fresh start. The new law establishes a “means test.” Anyone with income that exceeds the median income for his or her state will have to file under the stricter Chapter 13 instead, which requires a repayment schedule of up to five years.
  • Attorney problems – The more complicated Chapter 13 filings will make it necessary for filers to hire an attorney. Most attorneys who practice bankruptcy law are already reporting dramatically increased business; some are even turning clients away. If you need an attorney, hire one now, as they are soon going to be very busy
  • More attorney problems – The law also leaves lawyers legally responsible for the accuracy of the information filed on their clients’ behalf. This has led most lawyers to increase their fees. Some, including those who do bankruptcy work on a pro bono, or free, basis, have decided to forego bankruptcy work altogether. In short, it will soon be more difficult and more expensive to hire an attorney.
  • Mandatory credit counseling – Congress has required that debtors obtain credit counseling from an approved agency within six months of filing for bankruptcy. As of now, this requirement is largely undefined, with rules, regulations, and qualifications for counselors still up in the air.
  • Expect to may more bills – Some obligations, such as student loans or taxes, must be paid in full even after a bankruptcy filing. The new law lengthens the list of debts that cannot be forgiven.
  • The new legislation, rightly or wrongly, makes it more difficult, more time consuming and more expensive for a debtor to file for bankruptcy. Consumers who are considering doing so should act now, as the regulations will soon become stricter. Bankruptcy should always be a last resort option, but if you cannot avoid it, you should act quickly.

    How many opportunities do you have in your life to make a difference with your power of communication? Thousands! Dealing with your family, your friends, your business colleagues, suppliers, doctors, dentists – the list is endless.     Any surprises? That’s because in most of those questions I was using a technique that I call “sleight of voice.” You’ve probably seen a stage magician, perhaps on TV, use sleight of hand to misdirect your attention. The same technique can apply to spoken or written communication. For example, when you looked at the emboldened word SPECIES, perhaps you didn’t notice the name Moses quite as much as you might have if the word hadn’t been highlighted.

    This confusion or misdirection often occurs in everyday speech, sometimes deliberately, but usually the speaker is simply unaware of the effect of his or her words. Unfortunately, it is often the listener who is at fault, by engaging the “filters” in the brain and consequently mishearing what is said. Those filters are the paradigms through which they hear the world. Generalization of information and deletion of information are two other common filters that impede our ability to effectively listen, and therefore to successfully communicate.

    One of the simplest and best methods for keeping your filters in check and improving your listening skills is called Rapid Repeat.

    It works like this:

    When someone talks to you, simply repeat what he or she says in your mind, as the person is talking. You’ll hear a slight echo of the words, but in the sound of your own voice.

    This has a number of benefits. Some scientists claim that every 11 seconds we engage in self-talk. It’s no wonder that we don’t always hear what someone else is saying.

    When you use Rapid Repeat, you give your mind something to do. It doesn’t need to wander off thinking about next year’s vacation or whether you put the cat out before going to work.

    You’ll also find when you use this technique that your level of concentration increases and your recall of information improves dramatically. Just imagine having a conversation with a group of people at 7:30 a.m. and then meeting up with them again at 11:30 p.m. and being able to use their names and refer specifically to the detail of the conversation you had earlier. Wow!

    How Can We Build Enchantment Into Our Lives? – Part 2

    Thank you for staying with me for this two part article about how our environments add enchantment to every day living. This week I invite you to read about how my Virtual Assistant, Rebecca, put beauty, meaning and form into her home. Her story is different from mine, as each of ours are, but it is the same in the sense that it is her way of building enchantment into her life.

    Building Enchantment

    I wanted to share a little note about creating enchantment in your home. I recently moved into an
    old Victorian house that needs serious redecorating. A previous owner loved dark woods and shag carpets. (Not my style!)

    Since I work at home, I found it necessary to temporarily add some enchantment to ‘this old house’ because I spend so much time here. I took down dark drapes and replaced them with sheers to let the light in and, and sanded down and refinished some of the dark wood to give it a lighter appearance.

    What a difference! Now I love my new home and am even happier to spend my days here. We have a nice back yard that I plan to plant some flowers and shrubs in once the weather is nice. I have even developed a new interest in Feng Shui and sit glued most nights to the Home & Garden channel watching dreary homes get enchanting face lifts.

    I am reminded of an article of Dr. Holstein’s called Positive Spaces, which focuses along the same lines. When you are surrounded by enchantment and things that really reflect your own personality and things that you love, you create new warm memories by bringing out the best of the past.

    For example, my love of New Orleans has inspired me to create a Creole-style kitchen and my love of the Caribbean has inspired a soft bathroom with unusual colors. It is so fun to be creative and pull the best from your experiences.

    A Play Date with Building Enchantment

    You have now read two different accounts of making a house come alive with personal history. Take a few moments to reflect on what you have loved in the past. Was it what you saw on a vacation? Perhaps, actual household items, as I talked about. Perhaps a certain style or time period makes you feel great.

    What else would you like to bring into your life … new things … a new home …a garden … new clothes? Perhaps it is nothing physical, but things like more music, or time with friends. Whatever it is, take some time to daydream. Let our stories wet your appetite and give you encouragement to bring more enchantment into your life.
